2026 NIGHTMARE ON 190 WAIVER & RELEASE

Please read the following 2026 Nightmare on 190 Waiver and Release fully and carefully. Anyone who does not submit a valid waiver will not be granted admission to this event. A separate waiver will be required for each individual participant.

IMPORTANT NOTICE THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY BEFORE SIGNING.


By signing this Agreement, I acknowledge that entering and participating in a haunted attraction involves inherent risks, including the possibility of physical injury, illness, emotional distress, or property damage.


I VOLUNTARILY ASSUME THESE RISKS AND AGREE TO RELEASE CERTAIN CLAIMS AS DESCRIBED BELOW, TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW.


  1. VOLUNTARY PARTICIPATION 

I voluntarily choose to enter and participate in the Haunted Attraction identified above (the “Attraction”). I understand that the Attraction is designed to frighten, startle, surprise, confuse, and entertain guests. I understand that the Attraction may intentionally create conditions involving darkness, loud sounds, sudden movements, theatrical effects, frightening characters, confined areas, and other circumstances intended to produce fear or surprise. I understand that I may leave the Attraction at any time by following the applicable exit or emergency procedures. 1


2. ASSUMPTION OF RISK 

I understand and voluntarily assume the risks associated with entering and participating in the Attraction, including risks that are known or reasonably foreseeable. These risks include, but are not limited to:

• Slips, trips, and falls;

• Uneven floors, ramps, stairs, platforms, and other walking surfaces;

• Darkness, low visibility, and disorientation;

• Walking into walls, doors, props, scenery, or other objects;

• Accidental contact with actors, employees, other guests, props, scenery, or equipment;

• Being startled, chased, yelled at, approached, or frightened by actors;

• Loud music, screams, alarms, sudden sounds, and other audio effects;

• Flashing, strobe, or rapidly changing lights;

• Fog, smoke, haze, mist, or other theatrical effects;

• Special effects and theatrical equipment;

• Costumes, masks, makeup, props, and animatronic or mechanical effects;

• Crowded conditions;

• Physical exertion, rapid movement, or sudden changes in direction;

• Heat, cold, humidity, rain, or other environmental conditions;

• Anxiety, fear, panic, emotional distress, or other psychological reactions;

• Injuries caused by my own actions or the actions of another guest;

• Injuries resulting from ordinary negligence of the Attraction or its personnel;

• Medical conditions aggravated by participation;

• and Other risks inherent in or reasonably associated with a haunted attraction. I understand that this list is not exhaustive and that other risks may exist.


3. HEALTH AND MEDICAL CONDITIONS

I represent that I am physically and mentally capable of safely participating in the Attraction. I understand that the Attraction may not be appropriate for persons with certain medical conditions or sensitivities. I understand that participation may involve:

• Sudden fright or surprise;

• Loud noises;

• Flashing or strobe lights;

• Darkness;

• Confined spaces;

• Fog, smoke, or theatrical effects;

• Physical exertion;

• Rapid movement;

• and Emotional stress or fear.

I agree that I will not enter the Attraction if I believe participation could endanger my health or safety. I understand that I am responsible for determining whether participation is appropriate for me.


4. RELEASE AND WAIVER OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND AGREE NOT TO SUE THE HAUNTED ATTRACTION, ITS OWNERS, OPERATORS, MANAGERS, EMPLOYEES, ACTORS, AGENTS, CONTRACTORS, VOLUNTEERS, REPRESENTATIVES, INSURERS, AFFILIATES, LANDOWNERS, AND OTHER PERSONS OR ENTITIES ACTING ON ITS BEHALF (COLLECTIVELY, THE “RELEASED PARTIES”) FOR CLAIMS ARISING OUT OF OR RELATED TO MY ENTRY INTO OR PARTICIPATION IN THE ATTRACTION, INCLUDING CLAIMS FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS CAUSED BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. 

I understand that this is a release of legal claims and that I am giving up certain rights I might otherwise have. This release applies to the risks and activities described in this Agreement and to risks that are reasonably foreseeable from participation in a haunted attraction.


THIS AGREEMENT DOES NOT PURPORT TO RELEASE LIABILITY THAT CANNOT LAWFULLY BE RELEASED UNDER GEORGIA LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL OR WANTON MISCONDUCT. 


5. ACTOR AND GUEST INTERACTION 

I understand that actors may approach me, speak loudly, scream, yell, follow me, surprise me, appear suddenly, or otherwise attempt to frighten me. I understand that accidental physical contact may occur between guests and actors. I agree not to intentionally strike, kick, push, tackle, grab, restrain, threaten, or otherwise physically harm an actor, employee, volunteer, or another guest. I understand that actors and Attraction personnel are not authorized to intentionally injure guests. I agree to immediately notify Attraction personnel if I believe an actor or another guest has engaged in inappropriate or unsafe conduct.


6. PROHIBITED CONDUCT 

For the safety of everyone, I agree that I will not:

• Enter while intoxicated or impaired;

• Bring weapons into the Attraction;

• Intentionally strike or injure another person;

• Touch, grab, or assault actors;

• Climb on scenery, barriers, or structures;

• Intentionally damage property;

• Ignore safety instructions;

• Run where running is prohibited;

• Block emergency exits;

• Interfere with emergency personnel;

• Engage in threatening, abusive, or disorderly conduct;

• or Engage in any conduct that creates an unreasonable risk of injury. Management may remove any guest who violates these rules without refund.


7. ALCOHOL AND DRUGS 

I understand that entering the Attraction while intoxicated or impaired may create a significant safety risk. The Attraction reserves the right to refuse entry to or remove any person who appears intoxicated or impaired. I understand that no refund is necessarily required when admission is refused or a guest is removed because of intoxication, impairment, unsafe behavior, or violation of Attraction rules.


8. PERSONAL PROPERTY 

I understand that I am responsible for my personal belongings. I agree not to bring valuables or unnecessary personal property into the Attraction. To the fullest extent permitted by Georgia law, I release the Released Parties from claims for loss, theft, or damage to my personal property, except where such release is prohibited by law.


9. EMERGENCY PROCEDURES 

I agree to follow all instructions given by Attraction personnel, security personnel, emergency responders, or other authorized personnel. I understand that the Attraction may be stopped or evacuated because of:

• Fire;

• Severe weather;

• Medical emergencies;

• Power failures;

• Security threats;

• Equipment failures;

• Building emergencies;

• or Other circumstances requiring evacuation.

I agree to promptly leave the Attraction when instructed to do so.


10. MEDICAL EMERGENCY 

If I become injured or experience a medical emergency while at the Attraction, I authorize Attraction personnel to contact emergency medical services when reasonably necessary. I understand that I am responsible for my own medical expenses except to the extent otherwise required by applicable law or covered by applicable insurance.


11. PHOTOGRAPHY, VIDEO, AND AUDIO RECORDING 

I understand that the Attraction may photograph, videotape, or otherwise record guests during the course of normal operations. Unless I notify the Attraction in writing before entering, I grant the Attraction permission to use my image, likeness, voice, and appearance in photographs, video, social-media content, promotional materials, advertising, websites, or other lawful business purposes without additional compensation. I understand that I may be recorded incidentally as part of crowd or attraction footage.


12. MINORS 

A parent or legal guardian must sign this Agreement on behalf of any guest under the age of eighteen (18), unless the Attraction's written policies provide otherwise. The parent or legal guardian represents that he or she has authority to provide consent on behalf of the minor. The parent or legal guardian acknowledges the risks described in this Agreement and consents to the minor's participation.


13. MINOR — AUTHORITY TO SIGN; FALSE REPRESENTATIONS; UNAUTHORIZED SIGNATURES

For any guest under eighteen (18) years of age, the person signing this Agreement on behalf of the minor represents and warrants that he or she is the minor's parent, legal guardian, or other person who has lawful authority to provide consent and execute this Agreement on the minor's behalf.


The person signing on behalf of a minor further represents and warrants that:

(a) the information provided concerning the minor's identity, age, and relationship to the signer is true and accurate;

(b) the signer has actual legal authority to consent to the minor's participation in the Attraction and to execute this Agreement on the minor's behalf;

(c) the signer is personally signing this Agreement or is using a legally authorized method of electronic signature;

(d) the signer has not forged, copied, impersonated, or otherwise used the name, signature, electronic signature, identification, or personal information of a parent, legal guardian, or other authorized person without that person's actual authorization; and

(e) the signer understands that falsely representing his or her identity, relationship to the minor, or legal authority to sign may constitute fraud, misrepresentation, forgery, or other unlawful conduct and may subject the signer to personal liability to the fullest extent permitted by Georgia law.


If a minor or any other person knowingly signs this Agreement in the name of a parent, legal guardian, or other person without that person's actual authorization, the unauthorized signer shall not be considered an authorized parent or legal guardian for purposes of this Agreement. The Attraction may refuse admission to the minor, remove the minor from the Attraction, invalidate the purported consent, and take any other lawful action available to it.


To the fullest extent permitted by Georgia law, any person who knowingly makes a false or fraudulent representation regarding his or her authority to execute this Agreement on behalf of a minor agrees to be responsible for losses, damages, costs, and reasonable expenses directly resulting from that unauthorized or fraudulent representation, except to the extent such recovery is prohibited by law.


The Attraction may require reasonable proof of parental or legal-guardian authority and/or identification before permitting a minor to enter or participate. Acceptance of a signature or admission of a minor does not constitute a representation by the Attraction that the signer was, in fact, legally authorized to sign on the minor's behalf.


Nothing in this section is intended to create liability or waive any right to the extent such provision is prohibited or unenforceable under Georgia law.


14. RULES AND MANAGEMENT AUTHORITY 

I agree to comply with all posted Attraction rules and all reasonable instructions from Attraction personnel. I understand that management may deny entry to or remove any guest whose conduct creates a safety concern or violates Attraction policies. I understand that removal from the Attraction may occur without refund where permitted by the Attraction's policies.


15. INDEMNIFICATION 

To the fullest extent permitted by Georgia law, I agree to indemnify and hold harmless the Released Parties from claims, damages, losses, liabilities, costs, and expenses arising from my negligent or wrongful acts or omissions while participating in or attending the Attraction, except to the extent prohibited by law.


16. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Georgia, to the extent Georgia law applies.


17. SEVERABILITY 

If any provision of this Agreement is determined to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in effect to the fullest extent permitted by law.


18. ENTIRE AGREEMENT 

This Agreement contains the understanding between the guest and the Attraction concerning the assumption of risks and release of liability described herein. I acknowledge that I am not relying upon any statement or representation that is inconsistent with this Agreement.


ACKNOWLEDGMENT AND SIGNATURE I HAVE READ THIS

AGREEMENT CAREFULLY. I UNDERSTAND THAT ENTERING A HAUNTED ATTRACTION INVOLVES RISKS OF INJURY, DEATH, PROPERTY DAMAGE, FEAR, AND EMOTIONAL DISTRESS. I VOLUNTARILY ASSUME THOSE RISKS. I FURTHER UNDERSTAND THAT I AM RELEASING CERTAIN CLAIMS AGAINST THE ATTRACTION AND THE RELEASED PARTIES, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW. I SIGN THIS AGREEMENT VOLUNTARILY AND INTEND TO BE LEGALLY BOUND BY ITS TERMS.

By signing this document, I/we acknowledge that I/we have read and understand the entirety of the 2026 Nightmare on 190 waiver, including Section 13 regarding authority to provide consent on behalf of a minor or other party, and understand the inherent risks and voluntarily assume full responsibility for any injury, damage, or loss that may result from my/his/her participation. I/we hereby waive and release the business, its owners, and its staff from any and all liability, past, present, and future, relating to the services provided.
